As you may be aware, the Residential Tenancies Regulations 2010 (2010 Regulations) expire on 1 September 2025, and were required by statute to be remade.

The 2025 Regulations incorporate administrative amendments and include changes based on feedback received on the recent 2023-2024 reforms to the Residential Tenancies Act 1995 (RTA) and to the 2010 Regulations.

The 2025 Regulations, commencing on 1 September 2025, include the following amendments to the 2010 Regulations:

• an additional ground for terminating fixed term and periodic residential tenancies based on a landlord entering into a sales agency agreement with a registered agent to sell the rental premises;

• an additional ground for terminating fixed term residential tenancies for purpose built student accommodation provider landlords, on the basis that a student has not responded to a lease renewal offer within 30 days;

• the list of grounds for terminating a rooming house agreement has been expanded to reflect those termination grounds listed for residential tenancies;

• a new Rental Application Form (Form A1) has been prescribed to implement National Cabinet’s recommendation from ‘A Better Deal for Renters’; and

• minor administrative wording changes have been made to the prescribed forms to align with the wording in the 2025 Regulations.

New Form A1 will be required to be used by landlords/agents (excluding those entities listed in Regulation 8(4)) for applications by prospective tenants to enter into a residential tenancy agreement. A transitional provision has been added to the 2025 Regulations, to enable a period of four months for compliance with the requirement to use Form A1 (from 1 January 2026).

The Tenant Information Guide and Evidence Requirements for Termination have also been updated to align with the 2025 Regulations.
